Whose "side" are we on?
Our clients complained of disturbing noise from the restaurant below their residence. In this Special Referee's Report, whose findings were adopted by Supreme Court Judge Hagler, the Referee credits the testimony of Alan Fiersten of Acoustilog as "persuasive", while repeatedly finding the testimony of the opposing witness to be "unpersuasive".

Please note that where the report says that the restaurant "accepted the suggestions made by Fierstein in his report and undertook significant corrective measures ", they in fact had implemented only the least expensive recommendations, omitting the most important ones.

The restaurant was ordered to do further soundproofing work.

A summary of the referee's findings begins with the heading "Analysis" in the middle of the page below.
